Important Notice About Our Information Practices And The Protection Of Your Privacy

Purpose Of This Notice:

This notice is designed in accordance with Title V of The Gramm-Leach-Bliley Act (GLBA) and the laws of the State of California. It outlines the type of information that we collect about our insureds. It also outlines to whom we may disclose this information. The law obligates us to provide a copy of this policy to our clients before we may share their information with a third party. We are further required to provide our clients with a copy of the types of information we may collect, and to whom this information may be disclosed. This information is as follows.

Information We Collect:

The majority of the information we collect about our clients comes directly from our clients. If we require additional information, we are permitted by law to utilize the following sources:

  • Your applications or other forms
  • claims, billing, payment history, and other transaction information we receive from you, our affiliates, and others
  • information from other agents, brokers, administrators, and investigators
  • information from legal counsel, insurance support agencies, and government reporting agencies
  • information about your transactions with us from the insurance companies we use to underwrite your Insurance
  • the Department of Motor Vehicles and consumer reporting agencies
  • Gramm-Leach-Bliley Act (GLBA) information contained in medical records or from medical professionals as related to insurance.

We will not collect information from sources other than those listed without your approval.

Information We May Disclose To Affiliates And Third Parties:

We may disclose non-public personal information to the following affiliated and non-affiliated third parties in order to effect, administer, or enforce your insurance transaction:

  • claims administrators
  • other insurance companies that may write your policies on renewal
  • appraisers, inspectors, and other insurance support services
  • consumer reporting agencies and governmental agencies
  • a third party to enable that party to perform a business, professional, or insurance function for us
  • third parties to market products or services to you under a joint marketing agreement
  • an affiliate or third party in order to conduct an audit of the insurance institution or agent in connection with the operations or services provided
  • a lien holder, mortgagee, assignee, or other person having a legal or beneficial interest in the insurance policy
  • persons or agencies lawfully entitled, pursuant to a subpoena or court order
  • an insurance institution, agent, or credit reporting agency in order to detect or prevent criminal activity, fraud, or misrepresentation in connection with an insurance transaction
  • an insurance institution, agent, or credit reporting agency for either this agency or the entity to whom we disclose the information to perform a function in connection with an insurance transaction involving you
  • a medical institution or medical professional in order to verify coverage or benefits, inform you of a medical problem of which you may not be aware, or conduct an audit that would enable us to verify treatment
  • the California Department of Insurance or other insurance regulatory, law enforcement, or governmental authority in order to help prevent or prosecute fraud or if we believe that you have conducted illegal activities
  • a group policyholder in order to report claims experience or conduct an audit of our operations or services.

Our Practices Regarding Information Confidentiality And Security within Sweet and Baker :

We restrict access to non-public personal information to employees who need that information in order to serve you.

We protect that information with physical, electronic, and procedural safeguards that comply with federal
regulations.

Your Right To Access And Amend Your Personal Information:

You have the right to request access to the personal information that we record about you. You also have the right to know the source of any information we have on record. You have the right to know the identity of the persons, institutions, and institution types to whom we disclose information. You may copy this information in person or request that a copy be sent to you by mail. If we send you a copy by mail, we may charge you a reasonable fee to cover our costs. You have the right to request corrections, amendments, or deletions of any information that is in our possession. The procedures that you must follow to request access to or an amendment to your information are as follows:

In order to obtain access to your information, you should submit a request in

The request should include your name, address, social security number, and telephone number. You should also include the recorded information to which you would like access. The request should state whether you would like access in person or would like a copy of the information sent to you by mail. Upon receipt of your request, we will contact you within 30 business days to determine the best way for us to get this information to you.

To Correct, Amend, Or Delete Any Of Your Information:

In order to correct, amend, or delete any of your information, you should submit a request in writing to:

The request should include your name, address, social security number, and telephone number. It should also include the specific information in dispute and the identity of the document that contains the disputed information. We will contact you within 30 business days of receipt of your request to notify you that we have made the changes that you have requested. If we do not agree with the changes you have suggested, we may refuse to make changes at this time. If you disagree with our reasons for refusal, you may challenge them.

Our Policy Regarding Dispute Resolution:

We shall use arbitration to settle any controversy or claim arising out of or relating to our privacy policy or the breach thereof. This settlement shall be in accordance with the rules of the American Arbitration Association. Judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

Reservation Of The Right To Disclose Information In Unforeseen Circumstances:

In connection with the potential sale or transfer of its interests, Sweet and Baker Insurance Brokers, Inc. and its affiliates, if any, reserve the right to sell or transfer your information. The information covered herein includes but is not limited to your name, address, age, sex, zip code, state, and country of residency. We may also sell or transfer other information that you provide through communications to a third party entity. The said third party entity must concentrate its business in a similar practice, product, or service. The said entity must agree to be Sweet and Baker Insurance Brokers, Inc.’s successor in interest with regard to the maintenance and protection of the information collected. The said entity must agree to the obligations of this privacy statement.

Your Right To Opt Out:

If you do not want us to disclose personal information about you to nonaffiliated third parties, you may tell us so. This is known as “opting out”. If you wish to opt out, you may call us at 1-800-851-9865. You may also complete and return the form that appears below. If we do not receive information from you within 30 days, we are permitted to share your information. However, you are permitted to exercise your option to opt out at any time. You need only call or return the enclosed form. There is a limited amount of information that we are permitted to disclose to our affiliates regardless of the opting-out option. This includes the disclosure of information to our affiliates to enable them to market other products and services to you.
